The single worst thing you can do for your federal drug case is to sell drugs with a gun.

I’m in no position to give you advice on how to run your drug operation—
in fact, I really can’t.

But if you are arrested with a gun,
or if the prosecutor can somehow prove that there was a gun involved in your drug operation,
what that means is:

  • You will not be eligible for Safety Valve,
    which is a relief from the mandatory minimum on certain drug charges.
  • And you will also have to face consecutive time for the gun possession.

Generally speaking, the feds don’t like to take the drug charge and the gun charge,
combine them into just a drug charge,
and then enhance you two points for the gun.

So, when you’re really thinking through what you’re doing,
be mindful that:

  • Possession of the gun,
  • Brandishing of the gun,
  • Or discharging of the gun—

in conjunction with a federal drug case
may result in substantial time that is consecutive,
meaning one sentence after the other,
not concurrent.
