Elena Fast successfully challenged a client’s continued incarceration after prosecutors failed to establish trial readiness within the statutory 90-day period. The Appellate Division rejected the prosecution’s attempt to exclude delays in producing grand jury minutes, sustained the writ of habeas corpus, and directed the lower court to set reasonable bail or release the client on his own recognizance. People ex rel. Fast v. Molina, 219 A.D.3d 1384 (2d Dept. 2023).
